More time to prosecute sex crimes

New Mexico removes prosecution deadlines for second-degree criminal sexual contact of a minor and second-degree criminal sexual penetration. The law also delays the deadline clock for child abandonment or abuse and third- or fourth-degree criminal sexual penetration or criminal sexual contact of a minor. That clock starts when the victim turns 18 or the offense is reported to law enforcement, whichever happens first. A separate rule covers third- or fourth-degree criminal sexual penetration when DNA evidence is available and no suspect is identified. In those cases, the clock does not start until a DNA profile matches a suspect.
