State steps after unemployment appeal

After you serve your petition, the Administrator must file an answer within 45 days. If a motion to dismiss is denied, the answer is due within 45 days after the denial. If the Administrator files the appeal, the Administrator must serve the petition on each other party within 45 days. The Administrator must also file the full record and certify the documents and testimony to the court.

Stricter deadlines for unemployment court appeals

You must start a court case within 11 days after the Board’s decision is final, in the county where the job was. You must then serve your petition within 45 days after you start the case. Serve the Administrator at the designated Carson City office or the person the Administrator names. Service there counts as service on all parties. If you miss the 45‑day service deadline, or service is improper, the court must dismiss your case when the Administrator moves. If the Administrator moves to dismiss after timely service, you have 10 business days to fix every problem. If you do not fix them in time, the court must dismiss for lack of jurisdiction. These rules apply to petitions filed on or after the law’s effective date. The law takes effect when it is passed and approved.
