Drone use rules and privacy limits

The Department sets the allowed public uses for registered drones, including fire and emergency medical services, protecting critical public facilities, and search and rescue. Agencies may use drones for scheduled building and fire code inspections. But during those inspections, agencies cannot collect photos, images, or recordings. Any images taken in violation cannot be used in most cases or to build probable cause, except in a case about that inspection’s purpose. These rules apply starting July 1, 2025.

Public drone registry and annual report

The Department creates a public registry of drones used by state and local agencies, posted on its website. Agencies must submit a form for each drone with operator contacts, drone details, and how it will be used. The registry runs only if money is available. By February 1 each year, the Department sends lawmakers a report on public-agency drone use. These requirements apply starting July 1, 2025.

Tighter, U.S.-focused drone buying rules

The Department creates banned-source and banned-product lists for drones and related gear, including firms named by the U.S. Defense Department and items the state CIO already bans. Agencies cannot buy or use items on these lists. An agency may buy from a listed business only if all data stay in the United States, no third party can access it, the agency checks the seller’s policies first, and the purchase follows federal law. For these data rules, a “third party” means a foreign-based person or company; it does not include U.S. government entities. Agencies are encouraged to prefer U.S.-made drones when allowed. These rules take effect July 1, 2025.
