5 a.m. construction starts away from homes

When a county or city limits when construction can start, qualifying projects can begin by 5:00 a.m. from April 1 to September 30. This applies only to projects more than 300 feet from an occupied residential unit. Any local rule that blocks these early starts is void. Local governments can still set stricter hours for projects within 300 feet or outside those dates. A residential unit means a single-family home or one condo, townhouse, duplex, or apartment unit, not a timeshare or unit under NRS 119A. The law takes effect upon passage and approval.

Homeowner associations cannot set stricter summer start times

If the county or city sets construction start hours, a declarant‑controlled community cannot set stricter hours from April 1 to September 30. Any HOA or master‑plan rule that is stricter than this law is void. Communities may still set hours when no local rule exists and may set different hours from October 1 to March 31.
