Lease and farm sale money stays local

Money from grazing leases and farm product sales on State Parks land goes into the parks maintenance account. The Division tracks the money by park area or region. Funds can be spent only in the area or region where the money was collected.

Bidding rules for leases and sales

The Division must advertise leases and sales and can reject any or all bids. If bids come in too low, it may reject them and negotiate, but not below the highest bid. If a deed gives the original grantor a right to match the top bid, the Division must honor it. The Division may lease or sell to a state agency without bidding when the price equals what bidding would get.

New grazing leases on park land

The Division of State Parks can lease grazing and pasturage rights on state land it manages for up to 5 years. It may also sell farm products grown on that land. No lease or sale is allowed if it would interfere with scenic, recreation, science, or historic uses. It also cannot violate any special law for that area.

New rules on who can lease state land

The law limits the State Lands Administrator’s general leasing power where the new State Parks authority applies. For contract lands, the contracting party must consent to any lease or easement, and gets all money received. If another state agency uses the land, that agency must agree. The law also repeals a prior statute in this area.
