More protections and court checks for detained youth

Regional treatment-and-rehab centers for children now count as detention facilities under state law. The same detention rules and protections apply in those centers. Before a court sends a child to a state detention or regional treatment facility, the court must find two things. First, that community options that could meet the child’s needs do not exist or were tried and failed. Second, that a risk assessment under state law shows the child is a public safety risk, considering any delinquency history and the seriousness of the offense.
