AN ACT relating to crimes; expanding the crime of unlawful dissemination of an intimate image to include certain acts relating to the distribution of certain photorealistic images, digital images, computer images and computer-generated images; providing an exception to the crime of unlawful dissemination of an intimate image for persons who are less than 18 years of age; revising the definition of “intimate image”; providing penalties; and providing other matters properly relating thereto.

Minors exempt from this image crime

This law does not apply to people under 18. Minors cannot be prosecuted under this section for this crime.

Stronger rules against deepfake sex images

The law expands what counts as an intimate image. It now includes photorealistic and computer-made sexual images that look real. Sharing a fake image of someone without consent is a crime if a reasonable person would think it is real and the sharer meant to harass, harm, or terrorize. Images are not covered if the person cannot be clearly identified, or they exposed themselves in a public or commercial setting.

Felony penalty, no sex offender registry

Unlawful sharing of an intimate image is a category D felony. Sentencing follows the state rules for that felony level. A person convicted under this law is not labeled a sex offender and does not have to register or face community notice.
