Fewer HIV and hepatitis C insurance barriers
For policies issued, delivered, or renewed starting January 1, 2027, most Nevada health plans cannot use these treatment barriers. These include prior approval requirements and making patients try another drug first. The protection covers FDA-approved drugs to prevent HIV or treat HIV or hepatitis C, plus lab tests needed for HIV-prevention drugs. It also covers primary-care services within the provider’s scope, or safely provided with specialist consultation. Covered services from network pharmacists also receive this protection. Separate rules apply to the public employee and Medicaid plans described below.
Some public plans keep drug trial rules
Beginning January 1, 2027, managed care plans serving Nevada Medicaid or Public Employees’ Benefits Program members can retain step therapy. This means a plan can require patients to try another drug first. The public employee program’s Board can also use this rule when it provides a self-insured plan. This permission covers required HIV-prevention and HIV or hepatitis C treatment benefits, including related tests and listed provider services. These plans are allowed, but not required, to use step therapy.

SB217, AN ACT relating to health care; prohibiting a governmental entity from substantially burdening certain activity relating to assisted reproduction under certain circumstances; authorizing a person whose engagement in such activity has been so burdened to assert the violation as a claim or defense in a judicial proceeding; authorizing a court to award damages against a governmental entity that substantially burdens such activity in certain circumstances; providing certain immunity from civil and criminal liability and administrative sanctions for certain persons and entities involved in the provision of assisted reproduction; providing that a fertilized egg or human embryo that exists before implantation in a human uterus is not a person for legal purposes; requiring certain health insurers to authorize a pregnant person to enroll in a health plan during a specified period; requiring certain public and private health insurers to provide certain coverage for the treatment of infertility and fertility preservation; providing a penalty; and providing other matters properly relating thereto.
