Nevada funds public health, tightens tax collection
Beginning July 1, 2027, Nevada dedicates the first $4.925 million in insurance premium tax receipts each two-year period to public health. The money comes from the existing 3.5% tax; receipts above that amount go to the State General Fund. The Division of Public and Behavioral Health manages the new account. Each period provides $800,000 for statewide services and $225,000 per county outside a health district for Division services. Another $225,000 per county within a health district supports that district. The tribal share is $300,000. The law routes it directly to tribal health authorities if Senate Bill 312 was not enacted. If that bill was enacted, the money goes to the Tribal Health Account for the Tribal Health Authority Council. Available funding is divided proportionally when receipts cannot cover the set amounts. Eligible services include disease control, injury prevention, environmental health, family health, links to care, health records, and emergency planning. The Division posts funding estimates by December 1 in odd-numbered years. Health authorities submit needs reviews, priorities, and spending plans by January 1 in even-numbered years. The Division approves qualifying requests by March 1 and allocates money by April 1. Funds cover both fiscal years, but money not committed by June 30 of the following odd-numbered year returns to the account. The Division tracks that money separately and can use it for statewide or regional services. Any remaining amount returns to the State General Fund the following June 30. Account balances generally carry forward, but specified leftover and late-arriving money moves into a public health reserve. The reserve is capped at 4% of current-period account credits; excess returns to the State General Fund. Recipients report spending, unused balances, needs reviews, and priorities by October 31 in odd-numbered years. The Division reports to the State Board of Health annually by November 30, with its first report due October 31, 2029. Insurers remain responsible for the tax. Delinquent taxes face court collection, and insurers can face license suspension or revocation. Insurers retain the right to pay under protest and challenge disputed assessments. The law does not provide direct household payments.
