Broader teen protections with age-gap limits

Oklahoma raises the age cutoff in its age-based rape rule from under 16 to under 18. This rule covers specified vaginal or anal penetration. A separate rule limits convictions for rape or rape by instrumentation involving consensual intercourse with someone 16 or older. For that conduct, the accused must be more than four years older than the other person.

Rape protections cover more authority relationships

Oklahoma's custody-related rape rule now includes people in municipal custody or supervision. It covers intercourse with municipal employees or covered contractor or subcontractor employees who have authority over them. The law also covers students ages 16–19 having intercourse with school-system employees age 18 or older. It covers people 19 or younger in state or federal agency custody, or tribal court custody, with foster parents or applicants. Another rule covers secondary-school students also enrolled in college having intercourse with that college's employees. Covered college employees include faculty, adjunct faculty, instructors, volunteers, and contractor employees who exercise college authority. Enrolled students within three years of the other student's age are excluded from that employee definition.
