Superintendents must put any firing or non-rehire recommendation in writing, state the facts, and send it to the local board. If the reasons could support criminal charges or certificate revocation, or come from a civil-lawsuit settlement or agreement to avoid suit, the district must send the recommendation to the State Board of Education after due process or after a resignation while the educator is under investigation. The district must also report any such resignation and findings, give the educator a copy, and the educator can send the Board more information. Only school districts can request these records for hiring, and both the Board and districts must keep them confidential; they are not public records. If an investigation finds no basis for charges, revocation, or termination, the Board must expunge the report and notify all parties. If the Board or a district gets a subpoena for these records, the educator must be told right away and can object. These rules cover teachers and administrators and begin July 1, 2025.
The law sets July 1, 2025, as the start date for the educator dismissal, reporting, and privacy rules. It also declares an emergency so any parts without a later date take effect upon passage and approval.
