Educator records confidential and can be cleared

Only a school district can ask the State Board for your recommendation records, and only if it employs you or is considering you. The Board must tell you who asked and send copies to you and the district. You may add a written response, and the Board includes it. These records stay confidential and are not open under the Open Records Act. If a subpoena seeks them, you are told right away and can object before release. If an investigation ends with no findings for charges, certificate action, or firing, the Board must expunge the report and notify all parties in writing.

New firing and reporting rules for educators

When a superintendent seeks to dismiss or not rehire a teacher or school administrator, the recommendation must be written. It must list the legal basis and the key facts; for career teachers it must cite statutory grounds, and for probationary teachers it must state the cause. If the grounds could support criminal charges or certificate denial or revocation—or are tied to an agreement to avoid a lawsuit—the district must send a copy to the State Board of Education after required due‑process steps. The district must give you a copy at the same time. This also applies if you resign while under investigation for such conduct.

Emergency clause makes law effective now

The act says it takes effect July 1, 2025. It also declares an emergency, so the law takes effect upon passage and approval. In practice, the provisions are effective when the Governor approves the act.
