Beginning January 1, 2027, provider fees for service warranties are not subject to the premium tax. Instead, companies pay an administrative fee to the Insurance Commissioner. In 2027, the fee is 1.75% of gross provider fees each quarter, or $3,150 once a year for entities with qualifying March 31, 2009 insurance that elect the annual option. In 2028, it is 1.00% quarterly, or $3,350 annually for eligible electing entities. Beginning in 2029, all companies pay a flat $3,700 each year. The administrative fee is not subject to subsection C of Section 307.3.
Starting January 1, 2027, service warranty associations and insurers must file a yearly financial statement by May 1. It must be dated within the past 365 days and show all gross provider fees from the prior year. If you use the reserve option, it must be audited under statutory accounting. If you use a qualifying contractual liability policy, two principal officers must verify it under oath and use GAAP. The Insurance Commissioner may also require quarterly statements or special reports under oath. Late filers can be fined up to $100 for each day past the deadline.
