3 provisions identified: 2 benefits, 0 costs, 1 mixed.
Before a court hearing to dispose of seized or found property, the county must give public notice. In addition to first-class mail to known owners, it must post in three public places, including the courthouse, or publish in the county’s legal newspaper. If the county has no authorized legal newspaper, it may publish in a paper in an adjoining county. The notice must run at least 10 days before the hearing.
The law bans destroying firearms with historic military value. Sheriffs and campus police must donate them to a local unit of a federally incorporated veterans’ organization. The same rule applies to the State Bureau of Narcotics, Department of Public Safety, State Bureau of Investigation, the Attorney General, and district attorneys handling drug cases.
Agencies and district attorneys must use written agreements for any property transfer. The agreement may grant title, and transfers to a school district must be signed with the superintendent. Weapons cannot be transferred to school districts unless allowed by subsection K of the law.
