The controlling parent of a covered insurer group must file an annual group capital calculation with its lead state regulator. It follows national insurance regulator instructions and is due with registration, generally May 1 for the previous year. Exemptions cover single domestic insurers operating only in their home state with no assumed insurance business. Other exemptions cover qualifying Federal Reserve-supervised groups and foreign-supervised groups with recognized oversight or adequate information sharing. The lead regulator can allow limited filings or require calculations from foreign-based groups for financial oversight or market competitiveness. Groups losing an exemption must file at their next annual deadline unless granted an extension. Covered groups must also file liquidity stress test results when an insurer meets at least one applicable scope threshold. The lead regulator can adjust scope after consulting the national insurance regulators’ financial stability task force. Framework and scope data-year changes take effect January 1 of the year after adoption. Neither reporting framework allows insurers to omit information using the usual 0.5%-of-admitted-assets rule for treating certain transactions as nonmaterial.
Beginning November 1, 2025, Oklahoma’s Insurance Commissioner must keep specified group capital calculations, ratios, liquidity test results, and related information confidential. Protected records are exempt from public-records requests, subpoenas, and use as evidence in private civil lawsuits. The Commissioner can share confidential information, including trade secrets, with designated outside consultants. Consultants must agree in writing to protect confidentiality and confirm their legal authority to do so. Agreements must include security, use limits, applicable insurer notice and intervention rights, and consultant-identity notices for liquidity test information. Permanent database storage after analysis is generally barred, but liquidity test information is exempt from that storage restriction. Capital and liquidity measures are oversight tools, not consumer rankings; public disclosure, advertising, or ranking use is barred except as required by law. Misleading public statements about these measures are prohibited. An insurer can issue a written rebuttal solely to correct a materially false statement or inappropriate comparison in a written publication. It must first give the Commissioner substantial proof.
