Beginning November 1, 2025, Oklahoma minors age 16 or older can enter insurance contracts with signed parent or guardian consent. They can buy life or accident and health insurance covering themselves or someone in whom they have an insurable interest. This means a stake in that person's life or health that the law recognizes. Contracts can benefit their mother, father, spouse, child, brother, sister, or grandparents. For other types of insurance, minors must have an insurable interest in what is insured. Existing rules give minors adult-like control over these contracts, including surrendering their interest and accepting benefit payments. They are bound by settlements for other insurance and cannot undo contracts or contract decisions just because they are minors. However, minors who are not legally emancipated are not bound by unfulfilled promises to pay premiums, including through promissory notes.
Beginning November 1, 2025, Oklahoma shields the selling insurance agent from liability for failing to obtain required signed consent. This applies to parent or guardian consent for a minor's insurance contract under these rules. The consent requirement remains, but families cannot hold that agent liable for failing to obtain it.
