Defendants gain records access with limits

Beginning November 1, 2025, Oklahoma criminal defendants can require businesses to provide documents or recordings at a set time and place. These subpoenas cannot provide access to information or recordings about victim interviews in the case. After an endorsed complaint, indictment, or information is filed in a court of record, two deadlines apply. Law enforcement must send prosecutors existing arrest body-camera, vehicle-camera, and sobriety-test recordings within 30 days after filing. Prosecutors must make them available to defendants or their representatives within 90 days after filing. Prosecutors can hide protected juvenile records, details that threaten ongoing cases, confidential informant identities, safety or anonymity information, and out-of-scope material. They must give notice of these redactions; law enforcement can face contempt for missing the 30-day deadline.
