Bill Overview

Analyzed Economic Effects

4 provisions identified: 2 benefits, 1 costs, 1 mixed.

More time to correct death records

The law extends the deadline for correcting nonmedical death-record information from 60 days to one year after first issuance. A funeral director or someone acting as one must submit the request in writing or electronically. The request must include supporting documents or the funeral director’s sworn statement. This deadline does not cover medical certification information.

Rules can expand estate record access

The law lets Oklahoma’s Health Commissioner authorize access for people working in a record subject’s or estate’s best interest. Commissioner rules determine who qualifies to inspect, receive, or copy the vital record. Access is not automatic.

Amended birth records bar nonbinary labels

Since April 26, 2022, birth certificates amended under this section must list biological sex as male or female. The law bars nonbinary designations and symbols representing them, including “X.”

Minor record fixes require strong proof

The law defines minor fixes to birth, death, and other vital records, including spelling errors and mistaken additions or omissions. Applicants must provide clear and convincing evidence of an objective error knowable when the certificate was made or shortly afterward. Birth certificates receiving minor corrections more than one year after birth must be marked “amended.”
