Shops penalized for nitrous gear sales to minors
If you are 21 or older, selling nitrous‑oxide inhaling devices to anyone under 18 is a crime. The item must be made for inhaling nitrous oxide for recreation. A conviction can bring up to one year in jail, a fine up to $7,500, or both. After a prior conviction, the court must suspend the business license for up to one year unless the owner proves a good‑faith effort to stop illegal sales.
Legal uses of nitrous oxide stay allowed
The law defines nitrous oxide, including N2O and “laughing gas.” It keeps medical and dental use by licensed practitioners legal. Food products that use nitrous oxide as a propellant remain legal. Nitrous oxide with sulfur dioxide for automotive use and industrial or manufacturing uses are allowed. Restaurants and bakeries can use whipped‑cream chargers bought only from commercial suppliers, for cooking only.
Criminal penalties for nitrous oxide misuse
It is illegal to inhale or possess nitrous oxide to get high. Helping someone use it to get high is also illegal. A conviction can bring up to 90 days in jail, a fine up to $5,000, or both. Courts may require drug rehab during probation. Knowing sale, purchase, transfer, or possession of more than 16 grams is a misdemeanor with the same penalties. Letting it out to fill a balloon can be used as evidence you knew.
