The law retains May 30, 1990, as the cutoff for Oklahoma Employment Security Commission insurance rules. Otherwise eligible employees hired after that date join the state plan but cannot receive the specified supplemental or Commission-only benefits. Commission employees outside the agency plan at the cutoff were assigned to the state plan beginning July 1, 1990. Employees, retirees, and dependents participating in the agency plan at the cutoff have an option to transfer to the state plan. These are historical enrollment rules, not a new 2025 enrollment deadline.
Beginning November 1, 2025, the Oklahoma Health Care Authority holds recovery rights for covered employees and dependents injured by another party's wrongdoing or negligence. It can recover only the amounts it actually paid for the injury. It can reduce or waive recovery when repayment causes extreme financial hardship. If an employee or dependent releases the responsible party before submitting claims, that release must harm the Authority's recovery rights for penalties to apply. In that case, the Authority can deny claims or sue to recover paid claims, costs, and interest.
The law retains a historical $31.5 million allocation to the Oklahoma State Regents for Higher Education. It applies to the first receipts received after July 1, 1991, during the fiscal year beginning July 1, 1996. The remaining balance goes to the appropriate reserve fund as directed by the Oklahoma Health Care Authority. This provision creates no current household payment or benefit.
Beginning November 1, 2025, the Oklahoma Health Care Authority takes over key state employee insurance and flexible-benefit duties. It handles enrollment, eligibility, premiums, insurance funds, investments, retiree coverage, and health savings accounts. The Authority sets health, dental, and life insurance rates and benefits; its chief executive approves them before final approval by the Office of Management and Enterprise Services Director. A seven-member advisory board replaces the State and Education Employees Group Insurance Board and the Oklahoma State Employees Benefits Council. Members include the Insurance Commissioner or designee, four Governor appointees, and one appointee each from the House Speaker and Senate President. Appointees must meet investment, benefits-management, legal, or accounting qualifications; terms are four years, and compensation is $500 monthly. These changes do not specify new household premiums, benefit amounts, or eligibility rules.
