Beginning November 1, 2025, Oklahoma public trust hospitals with CMS provider agreements face new location limits. In communities under 30,000 residents, they cannot move their license or main CMS provider location more than 15 miles. Population is measured by the latest federal census taken every 10 years. When a public third party’s hospital lease ends, the CMS provider number returns immediately to the public trust hospital. That return follows federal ownership-change rules and does not guarantee continued hospital services.
Beginning November 1, 2025, public trust hospital trustees must complete education approved in advance by a statewide hospital organization. They must start within 90 days of appointment; the law sets no completion deadline. Certification as a Certified Hospital Trustee must come from a statewide hospital organization approved by Oklahoma’s State Department of Health. When a hospital is sold, trustees must certify they made no formal or informal job or role deals with prospective buyers for themselves or direct relatives. They must also certify they received no financial benefits, including noncash benefits, from prospective buyers and will receive none.
Beginning November 1, 2025, mediators must be appointed before a public trust hospital that announces closure shuts down. The hospital and its beneficiary municipality each appoint one mediator, and those two jointly choose a third. If the hospital and municipality cannot agree without mediation, the three mediators independently determine a purchase price. They use due diligence reviews and financial audits provided by the hospital. The hospital must transfer to the municipality if it agrees to pay that price and identifies suitable operating staff.
