Beginning November 1, 2025, Oklahoma courts presume some parents are unfit in custody or guardianship cases involving a nonparent. This applies to parents convicted of crimes listed in the Oklahoma Child Abuse Reporting and Prevention Act. Parents can challenge this presumption with evidence; it does not automatically decide the case. The rule adds a child-safety safeguard but can make obtaining custody harder for parents with covered convictions.
