Public buyers gain options with spending safeguards

Counties, cities, towns, state agencies, and other public units can share purchasing agreements with public buyers, including qualifying out-of-state organizations. Agreements can provide access to another buyer’s contract or lower-priced goods and services than comparable state-issued purchasing contracts. Construction services are included, but new construction is excluded. Purchases must follow applicable state purchasing, competitive bidding, finance, and administrative rules, plus federal rules tied to funding sources. State agencies must still follow statewide contract rules and use mandatory purchasing contracts. All agreement funds must pay agreement charges or direct administrative costs; no entity can take a percentage as profit. Purchasing Division references now name the Office of Management and Enterprise Services. The act lists July 1, 2025, as its effective date; its emergency clause also states immediate effect upon passage and approval.

Schools gain buying options with building limits

Oklahoma school districts, including technology districts, can join or run shared buying agreements with other public agencies for goods and services. These can include joint contracts and open-ended state purchasing contracts under the Interlocal Cooperation Act. Schools cannot use these agreements for new construction: buildings not previously built, occupied, or used. Bus barns, agriculture barns, storage buildings, batting cages, and similar structures are excluded from that ban.
