Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Community care gets yearly service reviews

Oklahoma's Department of Human Services must conduct annual performance audits of community-based Medicaid waiver services. The Health Care Authority must separately check that providers delivered billed services, as federal Medicaid rules require. Human Services must maintain community services, including foster care and supported living for people with Prader-Willi syndrome. Its Developmental Disabilities Service Division administers the program, and the Human Services Commission must set operating rules. These cover daily living support, health-related care, and safe medication storage and administration by trained workers. Worker-provided health tasks require training, agreement from the personal support team, and a physician's order. Basic nursing care can include tube feeding, blood glucose checks, ostomy care, oral suctioning, and inhalers or nebulizers. Human Services can seek federal funding and accept donated property, which must be used for its designated purpose.

Medicaid care providers get repayment protections

Oklahoma limits audit-based repayments for Medicaid home- and community-based care providers. For claims submitted on or after January 27, 2020, but before November 1, 2027, statistical projections cannot require repayment above the audited claim amount, regardless of the error rate. Statistical sampling also cannot create repayment liability above the total claims in the sample. The law invalidates earlier methods used under Oklahoma Administrative Code 317:30-3-2.1 for audit periods from January 27, 2020, through November 1, 2025. Repayment demands based on those invalid methods are void, and the Oklahoma Health Care Authority cannot pursue related repayments or financial penalties.

Medicaid providers get shared audit guidance

The Oklahoma Health Care Authority and Department of Human Services must jointly develop and refine Medicaid waiver claim audit methods. They must also create provider information and training covering audit standards, claim submission, and possible audits. The program must be ready for presentation to providers and their authorized agents by November 1, 2027. The Health Care Authority must still follow state requirements for reporting alleged fraud. The law takes effect upon passage and approval.
