Beginning November 1, 2025, Oklahoma small brewer license holders can accept payment when switching from self-distribution to a distributor agreement. Payment must be for the fair market value of their existing, established distribution business in that territory. The law sets no fixed payment amount or valuation formula.
Beginning November 1, 2025, Oklahoma's ban on distribution agreement incentives expressly includes any other thing of value. Brewers cannot accept money, property, or another valuable item from beer distributors in exchange for entering an agreement. The law retains exceptions for qualifying sales of an established distribution business.
Beginning November 1, 2025, Oklahoma beer distributors terminated in violation of the law can seek broader damages. These damages may include the fair market value of their lost distribution rights. They may also require the brewer or newly appointed distributor to buy remaining unexpired inventory at laid-in cost.
