Harsher sentences for repeat drug felonies

Beginning November 1, 2026, a second or later felony drug conviction under the listed law is sentenced under Oklahoma’s habitual‑offender statute. The statute lists exceptions, but most repeat felony drug crimes face tougher time. This is a sentencing rule, not a new program.

Extra fees on drug convictions

Beginning November 1, 2026, courts must add a $100 trauma‑care fee to convictions covered by this section. If you are found guilty under Section 2‑401, the court also orders a separate $100 assessment for drug education and treatment. For any conviction under the Uniform Controlled Dangerous Substances Act, the court may add up to 10% of the fine to fund drug enforcement. These charges are on top of fines and costs, and the money goes into state revolving funds.

Fentanyl test presumes cause of death

Beginning November 1, 2026, in fatal overdose cases, a positive test for fentanyl, a fentanyl analogue, or any mixture with fentanyl in the body counts as rebuttable prima facie evidence that fentanyl caused the death. Prosecutors can use this presumption, and the defense can challenge it.

Overdose reporting and immunity for first responders

Beginning November 1, 2026, first responders who reasonably believe a person is overdosing must contact local police as soon as practicable after giving medical care. The law protects responders who make the call in good faith from civil or criminal liability. Medical aid comes first; the call comes after care.
