Stricter limits and penalties on marijuana transfers

Effective August 1, 2026, you cannot apply to transfer ownership while you face an administrative action. Any appeal or discipline must end before you apply. If your license or OBNDD registration is revoked or suspended, you must wait at least six months after it ends to apply to transfer. Transferring a business or products without OMMA approval can lead to revocation or nonrenewal, and people involved can be denied future licenses. OMMA may also deny issuance tied to an ownership change or move if the licensee is under discipline that could lead to revocation, suspension, or nonrenewal.

Two-year pause on new marijuana licenses

From August 1, 2026 to August 1, 2028, the state pauses new medical marijuana licenses for dispensaries, processors, and growers. The OMMA director can end the pause early once all pending reviews are finished. The pause does not stop license renewals or licenses tied to a change in ownership or location. The law also removes the old rule that required OMMA to process applications filed on or before August 1, 2022.

New approval, fees, and steps for business transfers

Starting August 1, 2026, you need written OMMA approval to transfer a medical marijuana business. After OMMA approves, you must file with the state narcotics bureau (OBNDD). The old license and registration end 15 business days after the new OBNDD registration is issued. You must move all tracked inventory within 15 business days of the new registration. You cannot take possession or run the business until OMMA approves and OBNDD registers the new owner. When you take control, you must submit a full inventory of seeds, plants, extracts, concentrates, and products. You must keep filing on-time renewals so the business can operate while the transfer is pending. The transfer application fee equals the normal annual license or application fee. A buyer may work for the current owner during the transfer if they hold the required employee credentials.
