Agencies must file detailed budgets by Oct 1
Each state agency must send an itemized budget request by October 1 before each regular session. Requests go to the OMES Director and the chair and vice chair of the budget oversight committee. Agencies must use uniform, OMES‑approved forms and request money for the next fiscal year that starts July 1. Reports must include a performance‑based analysis, legal authority, measurable goals, who is served and how big the need is, tactics and outcomes, program rankings, recent spending and staff counts, expected program revenues, and how similar programs interact. Agencies must list outstanding capital lease debt and estimate capital lease needs for the next three fiscal years; capital leases include lease‑purchase deals and leases with a nominal‑cost option after a market‑rate period. Appropriated agencies must also list all staff and resources used for procurement, payroll, and accounting; higher education’s State Regents and their institutions are exempt. By October 5, OMES must list for the Governor and the oversight committee all agencies that missed the deadline.
Low-performing agencies must share financial services
By January 1 each year, OMES publishes each agency’s cost to provide shared services. Agencies that rank lowest must sign contracts with OMES for shared financial services if it is feasible and will save money. These contracts start at the beginning of the next fiscal year on July 1. An agency can leave shared services only if it proves it can do the work for less and the OMES Director approves. OMES publishes yearly reports that show savings. The State Regents and their institutions are exempt.
Agencies must certify past IT approvals
Each agency must certify that from July 1, 2011 to the law’s effective date it made no IT purchases or encumbrances without the State Comptroller’s prior written approval. This covers computers, software, telecom gear, IT hardware or firmware, and IT services and support.
Contracts and consultant reports posted online
Agencies must list every contractor, the dollar amount, and the status in their budget reports. For unfinished or pending contracts, they must give an estimated completion date and say if it is for services or to add staff. Agencies must post final consultant reports on the state purchasing website and link them to the original contract. If an agency already posts contract data, OMES can approve a direct hyperlink that will be maintained with other state contract data.
