Ban on foreign ownership of land and minerals
Beginning November 1, 2026, the law bans certain foreign people and governments from buying, owning, or leasing land or critical minerals in Oklahoma. It covers aliens, noncitizens, designated terrorist groups, Specially Designated Nationals, and foreign government adversaries. It blocks ownership directly or through companies, trusts, or foreign government enterprises. Critical minerals are those on the U.S. Geological Survey list. Businesses in regulated interstate commerce and entities with a national security agreement with CFIUS are exempt.
New affidavit required to record deeds
Beginning November 1, 2026, every deed recorded in Oklahoma must include a notarized affidavit. The person taking title or an authorized representative signs it and swears the deal follows this law and uses no banned funding. County clerks do not record a deed without this affidavit. Eight deed types are exempt, like corrective deeds, court orders, transfer-on-death deeds, debt security or release, public dedications, and deeds to governments or tribes. The exemption must be printed on the face of the deed. The Attorney General publishes separate affidavit forms for individuals and for businesses or trusts. County clerks may accept affidavits that substantially match the Attorney General’s form. The Attorney General may add exemptions needed for substantial compliance.
