Beginning November 1, 2026, if the Department finds a district failed to make full or partial scholarship payments before August 26, 2011, it can reduce the district’s State Aid or require repayment. The Department then pays the parent or legal guardian the missed scholarship amount.
Beginning November 1, 2026, the State Board may immediately stop scholarship payments to a private school for probable health, safety, or fraud risks. The Department must send written notice with reasons to the school and to parents or guardians. A private school has 15 days from receiving the notice to request an administrative hearing. The State Board must start the hearing within 60 days and issue an order within 30 days after it ends.
Beginning November 1, 2026, the Education Department posts a yearly public report on the scholarship program. The report shows total awards and dollars by school, denials, suspended payments, and student data by grade, years, race and ethnicity, disability, and economic status. The State, the Board, the Department, and districts are not liable for scholarship awards or use. Adding private schools does not expand state or district rules beyond what is needed to enforce the program.
This law takes effect November 1, 2026. On that date, the new notice, hearing, payment suspension, reporting, liability, and repayment rules apply.
