Beginning Nov 1, 2026, attempting or committing a gang-related offense to join a gang or while with a gang is a Class B5 felony. The same felony applies when the offense is to join, act for, support, or associate with a group on the U.S. State Department’s foreign terrorist organization list. A conviction carries five years in the Department of Corrections, in addition to any other penalties. Courts may rely on the State Department list to prove an organization’s designation. The law uses existing definitions of “criminal street gang” and “gang-related offense.”
