Counties can switch to five-member fair boards

Beginning November 1, 2026, county commissioners can vote to change the free fair board from nine members to five. The five members are elected by written ballot to three-year terms. One member is elected from each commission district, and two are elected at large by all county voters. Candidates must be registered voters; district-seat candidates must live in that district. Candidates file with the county clerk during a five business day window in January, and the election is held within three weeks after filing ends. If a district has only one candidate, commissioners can cancel that vote and declare the person elected. If no one files, commissioners appoint a director within two weeks after filing closes. Ties are settled by drawing lots under state election rules.
