Easier staffing rules for child care centers
Beginning July 1, 2026, if you have a bachelor’s or higher degree, you meet DHS rules to be a full-time child care center director. Annual continuing education still applies. A director may count as a master teacher for any age group. If you replace a master teacher, you get one year to meet the master teacher education rules, with one more year if you are actively working toward them. By July 1, 2026, DHS also sets master teacher-to-child ratios for 2- to 5-star centers, using the most permissive ratios that do not harm safety or quality.
Subsidy families: fees capped at 10%
Beginning July 1, 2026, and only after federal approval, licensed providers in the child care subsidy program may charge an extra fee above the state subsidy rate. Your total payment (your copay plus the extra fee) cannot be more than 10% of your household income. The Department does not pay any amount above its subsidy reimbursement rate. DHS must seek federal approval to put this in place.
Space minimums for infant-only rooms
Beginning July 1, 2026, infant-only rooms must meet set space minimums. If the facility opened or expanded before Nov. 1, 2016, it must provide 35 square feet per infant. If the space was first licensed after Nov. 1, 2016, it must provide 40 square feet per infant.
