Gas well operators face deadlines with exceptions

Oklahoma gas well operators must plug covered idle wells or bring them back into production. An idle well has no commercial gas production for 10 years and no reasonable showing of future use. For wells with at least 20 consecutive years without production before the law took effect, operators face three deadlines. They must reduce that group by at least 25% by July 1, 2028, and 50% by July 1, 2031. All remaining wells in that group must be plugged or producing by July 1, 2035. Other covered wells, including those becoming idle later, have 10 years from the law’s effective date—not from becoming idle. A sale, lease, or transfer does not change the deadlines. The Commission can grant good-cause exceptions for future production, injection, carbon storage, or geothermal energy use.

New well-plugging rules and oil-well safeguards

The Oklahoma Corporation Commission can set plugging rules for wells under its authority, with Commission employees supervising the work. It must adopt rules to carry out the law and establish necessary enforcement measures. For an oil well on an otherwise producing oil lease, plugging orders require a public hearing and an imminent-threat finding. The threat must be to public health and safety; gas wells do not receive this specific protection. The law took effect immediately upon passage and approval.
