Existing county land-use rules stay binding
When a county becomes subject to Title 19, Sections 868.1 and following, its covered existing land-use rules remain valid. These include comprehensive and master plans, zoning, floodplain and subdivision rules, resolutions, ordinances, codes, and related changes. Rules adopted under Sections 863.1 through 869.7, and actions taken under them, count as valid under the new authority. They remain in force until officially amended, revised, or replaced under Sections 868.1 and following.
New membership rules for county planning
Oklahoma county planning commissions have seven unpaid members. One seat belongs to the county board chair or the chair’s chosen representative. The county board appoints six others; each county commissioner nominates two residents of that commissioner’s district. Those six members serve overlapping two-year terms, down from six years; initial terms may be shorter. The chair’s seat lasts for the chair’s term in that office. Members can be removed for cause after a public hearing, and vacancies are filled through new appointments. The law took effect immediately upon passage and approval.
New rules for county zoning boards
County boards of adjustment have three, five, or seven members who own property and live in the county. The law removes the requirements for a county-seat resident and a licensed attorney. County commissioners nominate nearly equal numbers of members, and the county board assigns nominations that cannot be divided equally. Members serve overlapping two-year terms, down from three years; initial terms may be shorter. County boards can fill vacancies, appoint substitutes for disqualified members, and hire private lawyers for the adjustment board’s official duties. No legal spending amount or funding source is specified. Adjustment boards elect their own chair and adopt procedures consistent with zoning rules and this law. The chair or acting chair can administer oaths. Hearings are public, and minutes are public records. Appeals must be heard within 60 days of filing. At least 15 days before a hearing, notice must appear in a general-circulation newspaper and be mailed to neighboring landowners of record.
