Oklahoma wind farms face new lighting rules

The law requires systems that reduce wind farm lighting impacts while keeping turbines visible to aircraft. Beginning January 1, 2026, covered new Oklahoma wind farms must apply for federal approval before starting operations. Farms operating on or before that date without a system must apply when they repower or start or renew a long-term power sale contract. Repowering means rebuilding or refurbishing most of a facility because its useful or economic life has ended, not routine maintenance. Sales into energy or capacity markets alone do not trigger the rule. Applications go to the Federal Aviation Administration and, when applicable, the Federal Communications Commission. Approved systems must be installed within 24 months after approval and kept running under Oklahoma Corporation Commission rules. The Commission can enforce these requirements. Covered facilities primarily supply off-site customers; facilities entirely on land fully owned by the facility owner are excluded.

Wind farms pay lighting costs with financing

Beginning January 1, 2026, wind farm developers, owners, or operators bear all system installation, implementation, operating, and maintenance costs. Oklahoma counties can issue revenue bonds to finance some or all purchase, acquisition, and equipment costs. This option covers facilities operating without a system before January 1, 2026, and requires federal aviation and communications approval. Counties are not required to issue bonds, and the law sets no bond amount. Regulated utilities can seek recovery of their directly incurred compliance costs, but the Oklahoma Corporation Commission must review and approve recovery. Approved recovery could affect customer bills; the law sets no dollar amount or rate formula.
