The State Parks and Recreation Department now sets equipment and noise rules for off-road vehicles. ATVs must have working hand or foot brakes and a muffler in good order. The muffler must meet the department’s noise limits and run at all times. The department sets how noise is tested, and what flags and other safety gear are required on sand. Riding an improperly equipped ATV is a Class C traffic violation, and you may also be liable under state law. Motorsports events in designated areas must follow the department’s rules.
The law takes effect on its passage. Agency authority and enforcement start right away. Agencies can issue and apply ATV equipment and noise rules without delay.
