Sharing intimate images is a crime

The law makes it a crime to share someone’s intimate image without consent to harass, humiliate, or injure. It applies to photos, videos, recordings, and realistic digital or altered images. It covers uncovered genitals, pubic areas, female nipples, and sexual acts, including intercourse and masturbation. The person must know or should know there is no consent. The sharing must harm the person and a reasonable person. Penalties are a Class A misdemeanor, or a Class C felony for repeat offenders.

When sharing intimate images is allowed

The law lists when sharing an intimate image is not a crime. Allowed disclosures include law enforcement work, legitimate medical, scientific, or educational uses, and legal proceedings. Reporting a crime, serving a lawful public interest, public displays, and images made for commercial use with consent are also allowed. Online platforms are not liable for user-posted images under federal definitions of interactive computer service and information content provider. These limits narrow the ban to truly wrongful sharing.
