Beginning on the 91st day after the 2025 regular legislative session ends, DEQ cannot require a Title V operating permit for some air curtain incinerators. This applies only if the unit burns only wood waste, clean lumber, or yard waste. It also applies only when the unit is not otherwise required to hold a Title V permit under the federal Clean Air Act or EPA rules. If federal law still requires a permit, the operator must keep it.
