Telecommunications providers must pay an annual state fee of up to 0.35% of their gross retail in‑state revenue, with a $100 minimum. The commission sets the percentage at least 60 days before the year, and the fee is due by April 1 after the year. Providers must collect the fee by charging each retail customer a share and must show the charge on the bill. If approved base rates already include this fee and a separate line is added, the provider must file to lower base rates by the projected separate charge. A retail customer does not include other providers, telecom co‑ops, interexchange carriers, or radio common carriers.
Public utilities must pay an annual state fee of at least $10 and no more than 0.55% of their Oregon gross operating revenue from the prior year. For electric companies, exclude resale power revenue above a limit equal to 25% of last year’s end‑user sales revenue. Each year, the commission sets the percentage on or after March 1, gives notice, and sets a payment date at least 15 days after mailing. Utilities pay the fee to the commission. Existing ratemaking rules govern how these costs appear on customer bills.
This law takes effect on its passage. The fee changes apply only to fees the commission imposes on or after that date. Fees from before the effective date are not changed by this law.
