Which wind projects are covered and when

The law covers wind energy facilities with five or more turbines. At least one turbine must have required FAA obstruction lights, or have an obstruction light and a hub height of 75 feet or more. These rules apply only to projects that file an FAA hazard or no-hazard application on or after January 1, 2028.

Wind projects must use FAA-approved light controls

Developers must apply to the FAA, and if needed the FCC, to install and use approved light-mitigation systems. A wind facility cannot start or restart after repowering until these approval steps are met. When approved, the systems must be installed and used within 24 months of the FAA decision. If FCC approval is also needed, the 24 months runs from the later of FAA or FCC approval. If delays are outside the developer’s control, installation must happen as soon as reasonably practicable. Counties and cities cannot permit the project unless the applicant shows proof they made the required FAA (and, if needed, FCC) applications. You are exempt from installing if the FAA says the system is a hazard, if the FAA does not decide within 12 months, or if the FCC does not approve or fails to act within 12 months when FCC approval is required.
