The law protects access to discounted 340B drugs from pharmacies that contract with Oregon covered entities. Drug makers and their agents may not deny, limit, or interfere with a contracted pharmacy getting, delivering, or dispensing a 340B drug. They also may not demand claim or utilization review data as a condition to supply a 340B drug. These limits do not apply when the U.S. Department of Health and Human Services requires or forbids the action. The State Board of Pharmacy can fine a manufacturer up to $5,000 per day for each violation, and fines go to the Board's account. The law takes effect on the 91st day after the 2025 regular session adjourns sine die.
