State fund pays sexual assault exams

The Department of Justice pays for sexual assault medical exams when done within DOJ time limits and when the donor fund has money. Providers must give you the DOJ payment form and send it with the bill. They cannot bill you or your insurer unless DOJ cannot or will not pay. You can get care and have evidence collected without reporting to police or revealing your identity; DOJ cannot deny payment for that. A medical assessment includes offering emergency contraception and STI prevention, with a prescription for emergency contraception if you are 17 or younger. DOJ sets coverage rules and caps provider charges; exams for strangulation are paid under a different statute.

Protecting victims' identity and evidence

Providers must keep victims’ identities confidential and store evidence kits, then transfer them to the local police agency. Police must preserve each sexual assault evidence kit for at least 60 years and keep related evidence at least six months. Procedures must protect identity while allowing evidence to be retrieved and tested.

Hospitals must offer emergency contraception

Hospitals treating sexual assault victims must give clear, unbiased, medically accurate information about emergency contraception. Staff must tell female patients they can get emergency contraception at the hospital and provide it right away if requested and safe. The Oregon Health Authority creates and approves materials, sets content standards, and adds these duties to hospital care rules. The Authority responds to complaints and adopts rules to enforce these requirements.
