The law lets you ask the court to set aside certain convictions or contempt findings after you finish your sentence. You must have fully completed the sentence and not be under supervision. Class B felony: wait 7 years from conviction or release. Class C felony or contempt tied to an abuse or person‑crime order: wait 5 years. Class A misdemeanor: wait 3 years. Class B or C misdemeanor or other contempt: wait 1 year. File in the same court that entered the case.
The law lets you clear arrest, citation, or charge records after your case ends in your favor. After an acquittal or a dismissal that is not the prosecutor‑decline type, you may apply right away. Apply in the county where you were arrested, cited, or charged. If prosecutors decline to file charges, you may apply 60 days after they say they will not proceed. This applies only when no accusatory instrument was filed.
