New penalties and hearings for unlicensed trainers
Effective immediately, Pennsylvania authorizes civil penalties up to $25,000 per violation for training providers lacking a required state license. These penalties are in addition to other penalties under the Private Licensed Schools Act. A separate provision covers unlicensed commercial driving schools offering federally required entry-level training under rules applying from February 7, 2022. Driver-training penalties require a majority vote of the board’s full legally authorized membership. Under both provisions, each violation can receive the civil penalty only once, and providers must have access to a hearing before collection.
