Property owners gain protections against mine liens
Effective upon enactment, Tennessee law adds protections against property liens for abandoned-mine cleanup. Before filing a lien statement, the commissioner must notify the owner of the proposed lien, its amount, and avoidance options. The commissioner cannot file against owners who did not agree to, take part in, or control the mining that required cleanup. The commissioner also cannot file if the owner pays the department the stated amount before the lien statement is filed.
