Backup prosecutor if district attorney refuses
If the Memphis district attorney clearly refuses to prosecute crimes for unjustifiable or unconstitutional reasons, the Attorney General can ask the Tennessee Supreme Court to appoint a temporary prosecutor. If the Court finds such a refusal, it appoints an attorney from a list provided by the district attorneys general conference to handle the named offenses. The temporary prosecutor has the same authority and pay as the elected DA, but only for those cases. This keeps prosecutions moving when the local office will not act.
State review of Memphis prosecutions
The Tennessee Attorney General studies how the Thirtieth Judicial District handles cases from the Memphis Safe Task Force. The review covers plea deals, convictions, sentences, dismissals, and the DA’s reasons for reducing or dropping charges. It also reviews bail and pretrial-release recommendations, use of funds and grants, and any alleged misconduct. The Attorney General can access all DA records, even if not public, and must protect confidential information. The Attorney General may share needed information with the House and Senate speakers and legislators, who must keep it confidential. The Comptroller can help with audits if asked. A report is due to the legislative speakers by January 1, 2027.
