State and local plans cover biomarker tests
Qualifying state and local health plans must cover provider-ordered biomarker tests to diagnose, treat, manage, or monitor a condition. This applies to contracts issued, amended, delivered, or renewed to take effect on or after January 1, 2027. Tests must have support from qualifying FDA test or drug information, Medicare coverage decisions, or nationally recognized clinical guidelines. Plans must limit care disruptions, including repeat biopsies or additional sample collection. The law does not require coverage for screening people without symptoms. Plans can still use prior approval, but decisions and notices must follow state law. Patients and prescribing providers must have an accessible process to request exceptions to coverage policies or adverse review decisions.
TennCare members gain covered biomarker tests
TennCare must cover medically necessary biomarker tests, which check signs such as gene changes or protein levels. This applies to plans issued, amended, or renewed on or after January 1, 2027. Tests must help diagnose, treat, manage, or monitor a member’s disease or condition. They must have support from qualifying FDA test or drug information, Medicare coverage decisions, or nationally recognized clinical guidelines. Coverage must match other TennCare benefits in scope, length, and frequency. Prior approval decisions and notices must follow federal Medicaid rules in 42 CFR Part 438. Members and participating providers must have clear, public exception processes on TennCare’s and each issuing insurer’s websites. The TennCare Director can seek federal waivers needed to carry out these requirements.
