Veterans gain transfer option with jury waiver
Effective upon becoming law, Tennessee allows defendants to request criminal-case transfers to a bordering county’s veterans treatment court, despite conflicting laws. The receiving county must have 220,000 through 220,100 people, based on the 2020 or a later federal census. Its program must have authority to hear the case as though the offense happened there. Defendants must file a written waiver of their right to an impartial jury in the county where the crime occurred. The receiving county’s district attorney general must agree to accept the transfer. The court can still deny the request.
