Beginning July 1, 2025, legal notices posted online under §1-3-120(f)(1) are free to view. Websites cannot require a fee or a subscription to see them. This rule does not apply to notices required by §35-5-101 or to sample ballots under §2-5-211.
Beginning July 1, 2025, websites that publish legal notices under §1-3-120(f)(1) must follow new business rules. They must charge by the word at a rate comparable to what they charge other advertisers. Invoices must include an affidavit listing how many days the notice ran. The site must be separate from any newspaper’s website and not owned by that newspaper. These rules do not apply to notices required by §35-5-101 or to sample ballots under §2-5-211.
