New limits on third party bail

Beginning July 1, 2026, only certain people or approved groups can secure a defendant’s release on bond. Family means relatives within the third degree or people in the same household. A legal guardian has court-ordered authority over a minor. Groups other than the defendant, family, a legal guardian, the employer, or a professional bondsman authorized under §40-11-124 must be approved under §40-11-123 for each bond. These approved third-party groups can post for the same defendant only once per calendar year, and no more than $5,000 that year.
