Who counts as family for bail

Beginning July 1, 2026, the law defines who counts as family for bail. Family includes relatives within the third degree and people who live in the same home. A legal guardian is someone with a court order to act for the person. These definitions decide who can post bail without extra approval.

New limits on groups posting bail

Beginning July 1, 2026, only entities allowed under Tennessee’s bail law can secure a defendant’s release. Anyone other than the defendant, a family member, a legal guardian, the defendant’s employer, or an authorized bondsman must get approval for each bond they post. A non‑exempt group can post bail for the same defendant only once per calendar year. It also cannot post more than $5,000 for that defendant in that year.
